Is it offense not to inform immigration dept.?

We just terminated our DH for misconduct behavior. I read that we need to inform the immigration department within 7days. My question is if we do not inform the immigration department will it be an offense by law? I am aware that both employer and DH Need to inform the dept. but nowhere it says that it is an offense if we do not.

Unless you inform immigration you have terminated the contracted, you are still listed as the employer of record on her visa which would still be valid. As such, she can stay in HK and you are liable for anything she gets up to. When you notify Immigration of her last day working for you, she has 2 weeks to stay legally and after that she is subect to arrest and being deported. If that happens, she can't work in HK for at least 7 years. This is why it is important to notify....to protect you.

You made a very good point. We will definitely report on time but still it does not say if it is an offense not to report. Usually there is a comment about liability etc.

Why on earth do you need to know if it is an offence or not? It is a requirement, so just do it!
