Helper stealing

ORIGINAL POST

I have watertight evidence my helper has been stealing from us. I have not yet informed/fired her as am pretty sure it is just the tip of the iceberg. What are my rights with regards to searching her room?

If your evidence is watertight, why the need to search her room?

Some employers has open access to helpers' rooms as it's their home anyway...If it's serious, you better call the police and use your watertight proof.

Don't go into her room. Call the police and tell them all you know and if you have the evidence, then show the police.

I'd like to try and find more evidence (what I have at the moment accounts for approx 5K worth of belongings but as I said I am fairly sure this may just be the tip of the iceberg) plus I'd like to recover our belongings if possible (one item stolen was a wedding present).

I will certainly terminate her contract but undecided with regards to the police. If there is more evidence yes, but otherwise the trade off will be returning on the first flight back to the Phillipinnes. She has a young family she is supporting and losing her job and returning home may be punishment enough.

What I want to know is whether it is illegal to search her room?

As I mentioned, it's your home you can enter the room. But, you cannot search her belongings. You can do so with the helper and police present. If you're proven wrong, however, what will you do?

If you have 'watertight' evidence of you helper stealing from you, then you should report it to the police, don't warn your helper they are coming, and you can search the room with the police present.

If you just fire her without doing this, then she will only get a job with somebody else and the stealing will carry on. If she really cared about the family back home in Fils she wouldn't risk losing her job, and ending up in jail.

I will give my 2 cents worth here too:

IF she is stealing and you do not get the police involved, she can return to steal from another employer. If the police are involved. Yes, she will serve time, but the IMD will have a record of this and she will never be allowed to come back to work in HK again. You might consider getting the agency involved in this process also. They may send out a staff to speak to her and she will confess to them.

For the sake of other unsuspecting employers, you should consider getting the police involved.

Confronted her with the evidence we had. After trying to lie her way out of it realized she was cornered she admitted to it. Gave choice of escorting her to airport and putting her through departures or calling the police. She chose the former. Next question, is there any way of black listing her in case she tries to return?

its best to still tell the police. our helper stole from us and we tried to get the stuff back but she kept denying she had taken it so we tried to go to the pawn shop to look for it but the pawn shop will only open their records to the police. the police found she had taken our stuff (when you go to the pawn shop you must use your id card to get the cash so they have a very clear record) and she confessed but then tried to leave the country that night. they caught her at immigration and she did have to serve time (do you know about 80% of the women in hong kong prisons are filipinos?). when she got out she went back to the philippines, got a fake i.d. and came back to hong kong to steal from another family. while you hate to do it, it is best to report this to the police so that another family doesn't have to endure the same problem. in our case, our helper stole a very sentimental ring as well as the gold cuff links i gave my husband for our wedding. we never got these back b/c the pawn shop sold them off to someone who melted them down for the gold value. please think of the next victim she might harm and report this incident to the police.

I have a similiar situation on my hands. Besides her not following instructions, ruining things and breaking things....a pair of diamond earrings are missing. Of course she denied knowing anything about the disappearance. At one point when I was upset....she told me to deduct her wages for the earrings.........The earrings are worth 1000k US. Has anyone ever had this situation? I think she would be working a long time to pay for the earrings as she is already having payroll deductions for advances....(airfares to bring her daughters here for a 2 week visit...yes, I agree I was CRAZY when I did this) Daughters are due to arrive in a months time.

What a load of rubbish. Over 50% of the female prison population is Mainland Chinese so where did you get your figures from? You heard it........?

We've had it happen a couple of times. First time, we found a bunch of pawn shop receipts. We called the police, she ended up going to jail for a short time and being deported. We had to pay the pawn shop to get our stuff back!!! Shockingly it seems okay for a pawn shop to accept jewellry from helpers that's worth 100+ X their salary!

Second time, it happened, the girl was taking money from our wallets. We weren't sure who it was, as we have 3 helpers. So we took serial numbers of the money and left some out "accidentally". When it went missing so we sat them down and said "one of you has been stealing". Confess now, and we'll ask you to pay us back, and terminate you, but give you a chance. Don't confess and we'll call the police, you'll then end up in jail and being deported. After some time, the girl confessed, paid us back and we terminated her. We didn't call the police.
