No. From the Immigration Dept's website FAQs:

Q19: Can an FDH live away from his/her employer's home?

A19: No. An FDH should work and reside in the employer's residence in accordance with Clause 3 of the Standard Employment Contract (ID407). The employer is required to provide the FDH with free accommodation as per the standard specified in the "Schedule of Accommodation and Domestic Duties" of the employment contract.

Although some employers do have their DH live out, they are knowingly breaking the law and are prepared to accept the consequences.

It should be "no" according to Immigration but still a lot of people do it.HKID never check anyway.

They do if someone puts them up to it. The well-publicised (then) case a couple of years ago was brought to their attention by another PH helper who either got jealous or had some other sort of grudge and informed the ID. Yes, everyone does it, but they should be aware of the risks before embarking on ANY illegal activity.

It would be nice if the ID actually cracked down on live outs. Until they do though, you're more likely to be hit by a speeding minibus than to get caught out by the ID.

Plus you are in serious breach of contract and your own helper could use this as an excuse to quit and demand you pay notice.

If you were thinking of paying the new maid to stay at home (one of the options), would it also be an option to have her start as soon as she can and ask your current helper to leave then - and pay her for the doubling-up period? It probably wouldn't upset the current helper, in fact she would probably appreciate the extra time at home before the wedding particularly if she's being paid for it.

Why not take advantage of the situation to let yoru new helper be trained fr a wekk or so by the exiting helper?

Oooh, be careful there - it depends on how happy you are with the old one. You don't want her telling the new one either wrong things, or how to take shortcuts (the things you don't check-up on, for example) - no bad-tempered replies please - I speak from experience.

It will cost her a lot of money to pay the Agency thats why she's trying to be so clever here.

And actually under the laws you are responsible to reimburse her those fees...

i hired my helper from an agency and i dont reimburse her agency fees. i asked the agent about it and he said i just have to pay for my part of the fees, what he charges the helper is between the helper and him, has nothing to do with me. so i dont think you need to reimburse the helper's fee. where did you read it from, chefcrsh?
