In my opinion it is unfair to ask her to wait if you do not start paying her. She could start working for someone else next month and earn money that way.


My advice is to let this one go and get someone else closer to the time. There are many good helpers out there.

There's no "creative" and legal way out of this. You're going to put this girl in trouble by asking her to get in and out of Hong Kong trough Macau or Lowu.


If she's willing to wait, let her go home to her family and hire her when you're here. Before she goes back home, let her go to an employment agency and fill-in documents necessary for processing of a contract (be sure to get photocopies). When you're in Hong Kong, go to the agency and complete the process.


When a contract terminates, the helpers have at most 2 weeks to stay.

When the helper's current contract terminates, she needs to go home to her place of origin (home country). If her current employer is going home for good, she can actually find a new employer and the Immigration Department might allow her to stay and work for the new employer without returning home first (other cases might be due to financial incapability to pay, death, and as mentioned if the employer leaves HK for good).


All new contracts now has to go through an agency. Only re-contracts with the same employer can be done by the helper/employer themselves.


Since yours will be some kind of a direct hire even if you use an agency (the agency didn't make the match between you and the helper), the cost is lower. It's around 3K here in HK, some expenses for the helper in the Philippines as required by their government, the plane ticket, etc. However, you may need to wait 2 months more or less before the helper can return to HK (from the time the contracts were signed). Is that a concern?

Shouldn't this be a very good timing? You wouldn't be needing her these couple of months and she, with her visa expiring need to go back to her country of origin and would take about 3 months to process all papers. Get a reliable agency as a 'go-between' to do all the work and hopfully you will have your helper soon after your return to HK.

i think she can try to find an employer and once you arrive terminate her employer and be hired by yourself - IF she likes you more than her employer at that time

Sure, but quite frankly a lot can change in 2-3 months. If I were the candidate, I wouldn't wait around if I could find another employer.

Why don't you start the paperwork now, it takes on average 6-8 weeks to process a new helper, by which time you will be in HK and need her.
