Taking my DH to USA

Hi Friends,


We might be moving to the US for 8/9 months and would like to know if we can take our domestic helper along with us for that time period. We have a son 15 months old and we would be needing her help. Can anyone tells us if it is feasible/possible to take her along with us? Is there rule/regulation in the US regarding this? As we might be returing back after 8/9 months, we do not want to hire another new one as we and our son are getting used to the one we have.

Pls. note key points. Its a matter of luck that your application can be successful. This is due to a) doubts that most helpers does not intend to come back here in hong kong although obviously their employment is under the employer. In view of the circumstances that b) you have proven that you'll take her back WITH YOU, its still arguable. Its definitely c) ideal not to say she has a relatives (she may not have) and financially UNSTABLE as this will show that she cannot afford to support herself if she ever back off - means may also try to find DH employment. Finally, it is your d) right to argue and demand to grant a visa and by doing this you have to be persistent with a strong grounds that you desperately need your helper i.e. (helper fee in the US is expensive even part time and its inconveniences). I strongly advise that you speak to the superior consul if they rejected you as reconsideration might take place, It will all depends on how you will support your grounds. Also note that the consul are more likely to base everything on how you answer them as this counts a lot more than the documents you will furnish.



Expect that you will consume a longer time more than you expect becuase 8 to 9 months is quite a long time so advance preparation is needed.

I friend of mine just tried to take her DH to the US for the summer and the visa was denied. She asked around and found out the US consulate has gotten quite strict lately with DH going to the US. My friend has a 14 month old and the DH has been with them even before he was born. I also have another friend who has quaduplets, but they are about 9 years old. They wanted to take their DH with them to the US for summer and it was denied as well. So I just want to warn you that it looks dreary at this point. Good luck though =D

One more thing, if your visa is granted, you have to pay her the minimum wage of the state you will be staying for the duration of your visit. Citing the local prices for the domestic helper to the consulate officer as a reason to take your current helper is not a good idea.

I have a friend that works at the US consulate and she says that only under extreme circumstances will they allow the DH to go to the US with you.

One example she gave was that if the person is elderly or disabled and the DH has been the primary caregiver for a long period of time.

I agree..Bringing DH becuase employer need them is not necessariy extreme but it also does not fully gurantee a denied visa. as mentioned earlier, it is your right to demand to speak to the higher consul and insist that you DESPERATELY NEED her, accompanied with the grounds that employer will bring her back (i.e. employer to take that responisibility), eventually they have to issue one. Given the circumstances that a lot of employer wish to bring their maid (and this applies to every country that requires visa), consul has already acknowledged such situation and whether they like it or not they have to exercise their discretion of issuing visa, although not to all applicants and this is due to luck of emphasis that their DH will come back.


Since she is employed here in hk as your DH, tourist visa is a different category, she has to go back to her country to apply because she is a non-hk resident and it is unlikely that she may be granted, denied visa is just awaiting for her. Its a dead end situation and once you are rejected for such a visa it will stay as your permanent record and will effect in future application.

I hope the consulate educates the DH"s on their pay rights (overtime pay).
