According to the info at this link:
http://open388.com/~open388/0388-001/388-view.php?Redir=holiday , this year the day AFTER the Ching Ming Festival (Tuesday the 6th of April) is a public holiday but not the day of the ching Ming Festival itself.
Is that right? I don't really care which day our helper has off, just want to get it right and it seems odd.

Tuesday the 6th of April is a public and labour holiday so all helpers should have that day off but some people can change that to Monday if both parties agree to the arrangement.

According to this site http://www.labour.gov.hk/eng/news/latest_holidays2010.htm only the 5th of Aoril is a statutory holiday but not the 6th. The 6th is only a public holiday since Ching Ming festival falls on Easter Monday which is already a holiday.

Let me put it this way and hope you understand.......It just happened that Ching Ming falls on monday the 5th which is already a public holiday (can be termed as bank holiday) so the government issued the following day, the 6th as the official holiday for Ching Ming so all blue and white collar workers can enjoy the day.

Homely, you are incorrect. There is a difference between statutory and general holidays. 6th is not Statutory, thus not a mandatory holiday. You must give the 5th. You may give the 6th. The site linked by mike204 shows the only statutory holiday in April to be the 5th.
The 6th is thus like Good Friday, a commonly given but not mandatory general holiday.

Thanks for that axptguy38! Trust you to know the answer! So I'll just give her Monday off then. She's in her 1st 3 months with us but we still pay her for the public hols (we gave her CNY off with pay even though she'd been with us only a couple of weeks at that point).

We have never been strict about giving only the required holidays and the minimum yearly leave. "Breaking" that three month rule should be encouraged in my opinion. ;) We pay for every day, regardless of status. She certainly deserves it.

Can someone please confirm is myhelper entitled to Monday or Tuesday as statutory holiday or boh.

As mentioned above, Monday 5th is the only Statutory (i.e. mandatory) holiday in April.
