The rule is that you need to get her from home to you at the beginning of the (2 year) contract and from you to home at the end. That's it.

What about if you renew the contract?

Then it's the same. You send her home, you bring her back and send her home at the end of the second contract.

For every contract you sign with the DH, they get a round trip ticket or its worth basically.

For renewal, it depends whether your DH is going home or not before her next contract starts.

My DH renewed with us but because she already went home prior her contract ended, she deferrs her return home.... she just goes home next year. Some friends DH choose to exit to Macau or Shenzhen instead of going home.

If you owe your Dh a ticket to go home for your present contract, AND you need to pay for her ticket coming here (if she went home)... so you still have to give her the ticket's value in cash if she doesn't go home before her next contract begins.

So for her NEXT contract, you now owe her the "return" ticket going home (1 way).

OK. My DH is 18 months through her contract. If I send her home now for a 2 week holiday and then I don't renew her contract at the end of 24 months - does this mean I don't need to provide her ticket home?

What do you mean 'send her home now'? Nothing says when she takes holiday she can't stay in HK so you need not buy her ticket for her holiday. What you could do is get her to sign for a one-way ticket (the next employer whether you or not has to pay for any Philippines-HK ticket) or buy her a return ticket now if you will rehire her and state on the paper she signs that it is to be used as her final HK-Philippines/HK-P-HK ticket so if she uses it now then that is up to her.

This was discussed before, and there were people on the forum INSISTING the ticket is provided at the END or TERMINATION of the contract, and NOT earlier.

What I do is, I send my helpers home each year, so yes, that's 2 tickets a contract. For one, we split the costs. I pay for the return to HK (and she pays half for going home). At the end of the contract, she defers her exit, and next year, we do the same thing again. The other ticket, we pay for her as bonus.

So if you are 18 month through her contract, you want to send her home. You can ask her to pay for the half ticket, you pay for the other half, and when she renews with you, that portion that you paid already took care of the one way you owe her. New contract starts, starts all new again.

But if she isn't going home at the end of the contract, and you DO renew with her, you owe her a round trip ticket for the next contract.

I thought the law stated that you pay for her to come to HK at the start of contract and then again when the contract was over or on termination. If you choose to pay for a return ticket in between to allow your helper to go home for a holiday that is up to you but i doubt it would absolve you of the need to provide a ticket at the end of contract.

but when the helper DOESN'T go home at the end of contract and renews with you, you should pay her the value in cash. If the helper doesn't RENEW with you, and you haven't provided her the 1 way back home ticket, then you have to provide it.

The law states that because HOW else should it be stated. That the employer can provide a 1 way ticket ANYTIME during the contract ? ( That would cause MUCH confusion). That's why it is logical and clear, that for every contract, the FDH gets the air ticket provided by the employer....etc.

our helper likes to go home every year in August. But her contract finishes in December. So each year, she will go home in August, using one way air ticket's $ value..... then by end of contract, she defers her exit. SURE what I can do is LOAN her $ 1500 for her 1 way back, then she pays me back before end of contract, then she doesn't leave in December, so I pay her back $ 1500.

Come on..... what kind of a game would that be ?

So, give her the ticket at her convenience, SIGN in black and white that the value of the 1 way ticket that is end of contract has been given. Agreed by both party. Done.
