Termination question

ORIGINAL POST

My maid was issued with a 15th mth employment visa because of her passport which needed renewal. We do not wish to extend the remainder of her employment visa upto 2 years once it expires. So would like to know whether I still need to pay her 1 month compensation if I don't extend her visa.

You do, look at the employment contract - it clearly states 2 years.

Yes, the terms of the visa are outside the terms of the contract which states you must give her either one month's salary as notice or give her 30 days notice which would coincide with her passport renewal date, unless I've misunderstood your question.

Thank you to those who replied.

There's been a change in circumstances now since I last posted. My maid tendered her resignation a couple of weeks ago and is now serving out her notice. She has just found out that her last working day falls outside her visa expiry date. So does that mean she has to leave prior to her last working day? Does she have to tender another resignation letter to reflect this? Thx in advance.

Only the Immigration department can answer that question correctly. Get in touch with them.
