Visa Activation and Home for DH

Please help if you can.....here is the story.


We signed our DH in Aug. 2005 on completion of her last contract and defered her return to her country (Sri Lanka) on the contract she signed with us. In April of 2006 I sent her home for 2 weeks, so it completed her return to her country. (Not sure if she even had vacation time with us then).


This past Aug. 2007 we renewed her contract and again deferred her return to her country. My question is:


It states that she has to leave HK within the first year in order to validate her Visa. I understand that she can go to Macau or China and come back and her visa would be activated.


My questions:

1. Should I be sending her back to Sri Lanka for 7 days again since she hasn't been home for two years now or can she just simply go to Macau for the day and come back?


2. I understand we are required to give them 7 vacation days for every two years served but what if she doesn't really want to go home.


Can anyone help? Thanks in advance.

qvong It's actually 7 days holiday a year not every 2 years, if she doesn't want to go home it's not up too you too make her but she should have her holidays as we all need a break and time to re charge our batteries and time away from each other.

Sorry I mistyped. Moppet you are correct she is to have 7 days after every year. Don't get me wrong, my helper is great and I treat her well, by no means a slave driver. Firstly she is Sri Lankan and if you know what's going on there now, my helper has voiced she does not want to go back. She wants to go back in Dec. of 2008 for two weeks for her brother's wedding which I told her she can. But in the mean time her current visa needs to be activated and in Aug. it would be one year. So my pondery was whether or not she has to leave for 7 days now before Aug. Does that make sense?

Ah..have done that and can't get an answer. So crazy me actually went to immigration hopped from window to window to tell them I am inquiring. Took a number waited for 20 minutes to have an immigration officer constantly asking me which visa I want to choose for my DH. I kept telling him I don't want to choose a visa and that she already had one..yadda yadda. I kept trying to explain my story to him but he kept interrupting me to tell me what I have to do.."You need to choose 1+1 visa or 2yr." It just got to a point that everything got lost in the translation and no clear answer was given to me. So if immigration who made the rules can't tell me I am hoping that someone that has been in this situation can shed some light on my pondery. At the end I think she just need to leave HK and come back before this first year and does not have to go home to her country. I will then give her her vacation time in Dec.
