Can anyone provide guidance on the process of taking your domestic helper with you on returning home - in this case to the US? Two areas - the administrative issues and US side conditions, and the wisdom of such a move, where the helper (15 years in HK) would be out of her element

Hi HKdriver - please read the following quote which I found on another thread - I have saved it in case I ever think or know of anyone who thinks of taking their helpers back home with them!!!
[quote='mslee']
Do not bring your domestic helper to London, we just make a big mistake of bring our over. I took my father domestic helper over to help out for a year (that was the plan) and after four months, once she get hold of other Philippino in London, she wants 1200 pound per month, working Mon-Fri and no cooking. She now say that she got another job and is leaving us.
She has been with my family for more than 10 years, before we leave, we give her $8000 to buy winter clothes and pay for her ticket to London.
Despite all the promise she made in HK, once she is in London, she is a completely different person.
If you ever move back to London, it is much cheaper to hire a Polish or other eastern European house keeper than bring one over from HK.

U.S., of course is the same. I also saw some other threads complained about the same thing. Domestic helpers are just your employees and NOT your family members. Like every one else, they will/can leave you/your company for a better pay and future.

You will be responsible for complete and total support of your maid in the US.
You will pay minimum wage and overtime.
You will pay medical insurance.
You will pay taxes, and social security.
You will have to apply for a green card for your maid so that she can legally work in the US, unless you think you are a small buisness and can bring her on an H1B1 visa (which I doubt) and at that point you will need to show to INS proof, that you can not find anyone in the US to do the job that requires you to bring a person from overseas.
On the other hand, you can bring her as an au-pair to the states, and by pass green card issue, although I am not sure if there is an age requirement for au-pairs.
In the long run, it might be more cost efficient to hire a part time helper who already lives in the US.

Thanks ImSoBored - I was particularly interested in how the other people are bring DH's to UK, USA *legally* - I suspect most are not doing it legally, but on tourist visa. Besides, paying HK wages in USA and UK would be illegal as you point out.

I'm just in the process of weighing up the pro's and con's of taking my Ayi to Australia with me. As I understand it, after the health checks, visa and particular documentation pertaining to 'domestic workers for executives" has been prepared, you should have a contract in place, both parties obligations to one another. Furthermore the visa that they arrive on can be revoked if they change employment status. Therefore if your Ayi leaves you for another family, you can contact the relevant authorities and she will be asked to leave the country. As for wages, you should pay her what she is entitled to, isn't that what we all want?
