Direct Hire-called to say she does'nt want to join one day before the visa stamp day

Hi All,


I hired a DH who had finished her contract and she handled all paper work herself. I paid around 500hk$ from the processing fee.

I know its my mistake but I dont even have the copy of the contract we signed as she said it needs to be submitted to the immigration.


The date the embassy gave her was today i.e. 18th Nov. She called me yesterday saying that she cant join saying the job is not suitable for her blah blah. I agreed to cancel the contract and have asked her to collect the contract from immigration and bring them back to me today. I have typed in a release letter which I will make her sign.


The thing is that today is her last day of visa in HK. if she cancels her contract and cant find a new employer , she will have to fly back to phillipines. Now i am not sure how to handle this siutation. if she does not turn up today, how shallI go about cancelling the contract? and making her sign the document. can she create troubles for us?

Call Immigration and tell them what happened. Then write them a letter so it is official.

It looks like she duped you, sorry. But if she took 500hkd, do you know if she even went to Imm to use it for a processing fee, if she did you should have a receipt from IMm given to her' I will be surprised if she turns up with the contract you signed, or the receipt/money.

She may have already signed up with another employer and be processing with them, or getting money out of them!. If she tells Imm she has a possible employer and a contract they may give her an extention of her visa.

As she is not yet employed by you, nor her papers processed then you don't have to worry about whether she leaves HK or not, just be thankfull you didn't get to employ her, she is obviously a bit devious and dishonest.

Look for a new DH, with recommendation from a previous employer you can speak to before they relocate.

Hi

no she did show me the receipts of the payment so she did apply to the immigration for visa. on the receipt , it showd 18 Nov 2010 for collection. i mistakenly did not ask her to give me the receipts.


I just wrote a word document, mentioned her hkid, passport number and that she asked for cancellation of employment application. so i asked them to cancel our application and fax-ed it to the immigration fax number.


should that be sufficient for cancellation of the application?
