The DH employed by our friends stole most of their expensive stuff while they were away from HK and fled. Police report was made and they concluded that DH has left the country and they can't do anything beyond that.
Can anyone help/advise what actions can be taken either in HK or in PH where she must have gone to.
We can discuss any legal angles and support which can tactfully be obtained from HK police within the scope of their duties. We do understand that the HK police may have many priorities in not pursuing the cases of this type.
We are willing to pay for legal help if that can help.
Thanks in advance for all help!
John

Hi,
Yes, we have full details and we have tried to approach NBI in Manila and in the provincial office, but were told that since the incident occured in HK, NBI can't take any action. Least of it being to investigate her. STrange!
Let me know what is your suggestion and advice?

Can you send me the details of this person privately? I'll see what I can do to help.

Hi,
I feel employers have no protection on these matters and others. Whereas the helpers have protections both from the HK and Philipines Gov. I was surprised that the HK Gov. allow the Phill. consul. to force employers in HK to purchase a seperate 1 year insurance coverage for the DH and family back home apart from the one thats in the contract. What happens if you terminate her within a month or so, good luck for them because they are already covered for an entire year by someone in HK that they dont even know? Then employers would have to purchase another coverage for the new helper and her family again, isn't it? Employers are cheated hee expecially on this one and can't do anything about it just like when they steal or damage our valuables.
See, according to John they stole her valuables and I think nothing can be done about it. But if employers here break the simplest of rules where they are consern, then they immediately have to pay the consequences.
Helpers would be allowed extended time here in HK to take us to court, but we can't do anything once they leave the country. just isn't fair.

Hi,
Thanks for your replies. I am more interested to know what can I request from HK police. It looks like they will not take the case further since the lady has left HK. AND, in PH they will not take it up since it did not happen in their jurisdiction. yes, we have compalined to consulate, but that is a slow process, I am told, and may take several weeks whereas our interest is to nab the DH asap so we can make some recoceries (some hope!).
Still looking for some help or is it that we were the first "unlucky" ones to have been the victims.
Regards

I think Aijin has put the whole thing in perspective. My friends are exactly at that situation that HK police says they cant help as the DH (who made the teft) has left the country and the PH consulate also can't help beyond accepting a formal complaint.
Can any lawyer help? We have not yet contacted a lawyer becasue the lawyers are expensive and it may be the situation of throwing "good money" after "bad money". May be there are some good, effective and not so expensive lawyers then we would like to contact them so at least be able to weigh the options. Please suggest contact details.
However, if there are any other ways, which we may also be considered, then please advise. Shall be grateful!

I don't think any ethical lawyer will take on the case because there's no chance of a positive outcome for your friends. (On the other hand a 'less-than-ethical' lawyer might take it up on an hourly rate basis in the fullknowledge that it would be money for time spent and not payment based on successful outcomes.) The problem is that the helper, if found, would simply deny any theft, and there'll be little chance of any proof. Hence no case. I think you might be throwing good money after bad.

Hi TC,
You raise an interesting point that she will deny.
In these cases how does one proove? She was working and then she suddenly fled before our friends arrived back home. Never to be traced, not even at consulate. Does not this proove the guilt?
Police report has been filed. How can then she still be able to claim that she did not steal? Then why did she not present herself?
I think I am confused. What else will then be an evidence against a theft made by a DH when no one else was at home?
How do other people on the forum ensure that if ever their DH steals and runs away with their property then they can at least convince the legal authorities or insurance company that DH stole the stuff?
Surprise! Suprise!

Dear HK2,
Thanks for your suggestions!
Our friends will definitely want to look at all LEGAL angles first and only if they have exhausted them will think about il-legal ways to send goons after her. We are God-fearing and law abiding citizens and look forward to some legal solution either in HK or PH.
Thanks.

Have you tried or has the means to contact the local baranggay ( Local villages) officials from the city/province where she came from? A " threat" from legal issues may not worry her much, especially if she knew she can't be proven guilty beyond reasonable doubts. However, the possiblity of being exposed for such crime and the shame she will bring to her family could soften her up into confession.
