Am writing on behalf of my friend who is without internet.
She has been 'trialling' this helper whilst the documents are being approved, she had to submit fuirther doc's for finalisation which will be done end of the week.
however she isnt too keen on this helper and doesnt want to contine the contract. is she able to pull the plug although in theory it hasnt been approved even though the contract has been signed and submitted?

Correct me if I am wrong. This "trialling" is illegal. Even if there was a contract, this is not enforceable. If she doesn't submit further docs for processing, the application will just die a natural death.

a contract can always be cancelled.
from what i hear though the helper may try to make trouble for your friend. she'll have to sit down and explain things clearly to the helper as to why she isnt going to go ahead.

You have to just inform immigration about stopping the processing of the contract.
You can fax the letter to them.

As isonoawabi says if your friend does not submit the final documents it will die a natural death. Would suggest though that she sends letter/fax to immigration to inform them that the contract is no longer being processed. She can then go ahead and process papers for a new hire. The helper is not in a position to make any trouble for your friend as no contact has been completed so i am not quite clear as to what six is saying.

ok thanks. yes, she is aware its illegal as is the helper and her helper has been treading very carefully so i doubt the helper will give her any trouble. shall revert your comments on to her. thanks again.

don't know what stage it is at, but if the helper has been inconvenienced (like visa issues, has to return to own country because of this etc), then your friend should do the right thing,
and by that I mean compensate her accordingly, and pay her off properly and generously.
Don't forget, the helper has risked imprisonment out of necessity for work (that should tell you how desperate they are) so your freind can pick and choose and do a trial........your friend risking what a mere 50,000 HKD fine and a ban on being able to have a helper for a year or two.......who has worn all the significant risk.
The last thing we need in Hong Kong in repsct of domestic helpers is employers further exploiting their desparation for money to provide basic living necessities (food, shelter) for their own family.
From time to time, one may justify stretching some red tape, but when it is a one-way advantageous stretch, you have to examine your own morals, .

from what i hear her new helper treats my friend likes she is the boss and goves attitude in the first week of work.....talk wont help if this helper is already showing her true colours!!!!
