Help please re. helper vacation.

My helper has started her 2 yr contract since September 2005 with us. Now she wants to take her 14 day vacation in February to visit familiy before finishing the 2yr contract.


1. I am fine with it but is this done usually?

2. So she is basically taking her vacation (paid) first - does that put me in a bad situation? we have a fine relationship but there's always a question in the back of my mind that what if she just not come back - so I'll be paying her 1/2 month without work, and will be paying her way home for free (has not finished contract.)


comments? i am all new to this and have no idea what's the right way to do things.

To cover that possibility I'd be paying her only for the pro rata that she has 'earned' up to the time of taking the leave. She is fully entitled to the 7 days for Year #1, but she should be clear on the fact that she is not entitled to the leave until each 12-month contract period has been completed, and that by paying her a pro rata in advance you are actually doing her a favour. So to be technical I don't believe she is even entitled to the pro rata, but I think you'd be pretty mean not to pay her for that. And you are not obliged to pay for her return trip unless it is at the end of the contract.

TC--I think an employer still has to pay if a helper worked for more than 3 months. At least, when I terminated my helper who worked for me only 9 months, I was told by the Labor Department hot-line operator that I had to pay the pro-rata. The operator even helped me to calculate the days -- 5.6 days.


Newbie123--I agree with TC, pay her the pro-rata. Oh, and don't worry about the ticket to the Phil. You still have to pay for it even if you terminate your DH. In your case I'd pay for the ticket and get your DH to sign it. BTW, a return ticket will not be much more expensive than a one-way.

BTW- our helper always arranges to buy her own ticket and we reimburse her - she gets great 'helper only' deals. Many airlines offer these.

You don't need to buy her airfare for holidays, only a one way ticket to come to HK at the start of the contract, and a one way ticket to return home at the end of the contract. Any holidays in between are down to the helper. Also they are not limited to 14 days,thats paid leave, you can give them us much unpaid leave as you want. Our last helper went back for 3 weeks each year.

hello newbie,know what? you are the boss,you can allow her to go vacation on february "IF" you want,but if you're confused,just simply "not" allow her to go vacation then,just tell her that you are following the contract,when she finishes her contract that's the time she could go vacation..as simple as that.have a nice day!
