We recently took on a DH whose previous employer terminated her contract due to them leaving HK. As she had last been on leave to Manila at Easter this year, when employed by them, she did not want to go again so soon, and Immigration agreed that she could defer going back again as long as she goes within 12 months of being employed by us. What I want to know is, when she does go, is the cost of this flight up to us to pay, or should her previous employer have provided the money for it, due to the fact that she didn't go back to Manila at the end of her contract with them? ... Am I right in thinking that employers pay for the flight at start and end of each 2 year contract? I have no problem paying for her flight if that is what I am expected to do, but just wondered if her previous employer should have paid for this, as it's not quite so straight forward as if she were just at the end of her 2 year contract with them. The previous employer should have already paid for the one way home at the end of the contract, also any untaken annual leave days, plus one hundred dollars per day for extra travel to the home province. This is part of the green contract numbers 6,7 and 8. You should pay for one way back to HK.

Thanks, I thought that was probably the case, but suspect that she will say previous employer didn't pay her for it, and I've no way of knowing whether or not they did, so will no doubt end up paying for it myself anyway.

You shouldn't pay for this. Every DH in this city knows the employer pays for the one way back home. If they don't it is a slam dunk case for the Labour Dept. and you shouldn't offer to pay this b/c it will set the precedent for your future relationship that you will always be that person who makes things right. If you don't think she has the money, make a deal with her that you will loan her the price of a one way ticket and she can repay it after her first month's salary. She knows all of this anyway!

So, just to clarify, what you're saying is, even though she didn't return home at the end of her contract with previous employer, but needs to return sometime within the next 12 months, she should have been given the money for this by the previous employer ... is that correct? Then we give her the ticket home at the end of contract 1st contract with us? Sorry for all the questions ... just want to do the right thing! Thanks!
