Hello,


If a helper resigns from her job, can she take another job straight away ? Or does she have to go back to the Philippines and reapply for a visa there ?

Why you care if she is resigning? She is the one to find it out but not you. Save your energy n get a new one is far more better, dont you think?

Mighty, I may be interested in hiring a maid that is about to resign from her current job, that is why I'm asking this question.

I want to know if she has to go back to the Philippines or not.

OK, case by case. Is her present employer in financial difficulties or she is leaving HK for good? If that is the case, your potential helper may be able to stay on without going back to her country. There is a white form for you to fill in saying 1 year deferral. But if she has not gone back to her home country in the last 2 years contract, then most probably the deferral wl not be granted. Mighty, thanks for your reply.

She's resigning after 5 months with this employer (they don't get on well). She's been in HK for 5 months only.

She's the one breaking the contract.

So I'm wondering if she'll have to reapply for her visa in the Philippines or if she can do it here ????

This is difficult. But I am sure if you really want to employ her, you can write a nice letter to the Immigration Department explaining to them your eagerness to employ her. I think your chance is 50/50. You can call the Immigration and hv a chat with them before she resigns. Otherwise she might be ending up no where to go.

As far as I know, once DH resigns, she has to go back to the Philippines no matter what the reasons are. A good source would be the employment agencies. They know the answers to all questions related to DH inside out.

She will definitely have to go baCK and wait for her visa in the Philippines. Just a tip, do not be too choosy. I interviewed 100 helpers and chose the one that had ten years experience and she ended up one day with me. The reason is she slept at lunch time on her first day. Sometimes its just pure luck if you find a good one.

People have the tendency to hire helpers with more experience because they think more experience means good. But in my 'experience', that is usually not the case with domestic helpers. It is a high labour consuming job. Long hours and almost without stoping during the day. A 10 years' experienced helper might mean she is quite 'old'. Of course, it also depends on whether the household has children or not and how many. Having been working here for 10 years might also make her into a laidback helper. Or already too exhausted. May be that was your case, highdesertnow. Agree with you that we shld not be too choosy, but at least hire someone you feel comfortable with.

But talking about sleeping at lunch time, I did tell my helper to have a nap while my little one is sleeping in the afternoon. So that she can recharge and spend time in better shape with my dearest daughter later in the afternoon.

Ladyfrog, there is definitely some categories where the dh does not have to return to the country of origin to await visa processing. They are as were mentioned by someone else, if the employer is releasing them from the contract because they are leaving for good, if they just don't need a dh anymore (kids gone, mum in law moved out) or if they can no longer afford one. They have to write a letter to say this to immigration so you must check with the current emplpoyers that they are prepared to do this otherwise it will just look like she was either fired or broke contract in which case she will definitely have to return to her country of origin to await her visa application being processed which can take several weeks. I have several friends who have gotten new DH's recently who have been able to apply for them to defer going home, one that I was talking to on the weekend who is getting a new one this week and they don't even have kids (but both work) and immigration has approved her not reutrning now. Just speak to the current employers. My own helper (whose old boss just flew into HK and had morning tea with us :) ) was leaving to go back to Australia and immigration let my dh come straight to me, however she had a such a release letter from them along with glowing references and a clean record from the last 17 years at immigration. She had not been home in the last five years and they still approved her staying here. This was in October 2003.

When the helper is the one terminating the contract, she must return to her country of origin for processing; there are no exceptions. And this can take up to 2 months or more, so you don't want to do this unless you don't need your helper for a long time.

Ladyfrog....maybe you are not interested in knowing this but it is advisable for you to speak to the helpers employer to find out what is the reason they are having problems. Maybe you know ony one side of the story.

If a helpers resigns, it could happen to you too, if she decides to. Are you interested in Sri lankan helpers? If you are, I can get a phone number of a lady who will try to get as many girls as possible for you to interview. I had a PHIL & now a S Lankan & I have to say, she is a great choice.

Sorry...I was out of town. The lady whose number I have is called GIRTY. Her number is 91308574. She is S Lankan & will get you many SL girls to interview. I got my DH through her. She did not charge me at all. I personally dont know her, but have found her to be influential in contacting DH for jobs.
