Hi Everyone, I hope you can help me to answer a few questions that I just can't seem to find answers for. We have spent the last week interviewing DHs and have found someone we hope will be a great first helper. As it's our first helper (we're quite new to HK) I feel like it's all a bit out of control! DH has great references and will be released from her contract mid Sept due to financial reasons and age of children. She has a release letter and we will complete the contracts at the weekend. However, I have a few queries:
1. Am I right in thinking that if she is released due to financial reasons she doesn't need to leave HK?
2. If that is the case, does that mean she has to have a health check in HK or not - do you advise that we do even if not required?
3. If her contract finishes on 20th Sept and the new visa is not ready yet (which I understand is likely) what will happen to her during the time between contracts - where would she live/how would she manage etc?
4. If she doesn't leave HK before starting a new contract, my friend says that she would have to go home during the first year of her new contract - is this correct?
Sorry for the many questions but it's all new, very confusing and I don't really know where to turn. Any help you could offer me would be great. Thanks in advance, Rosa

1. Yes if she is released due to financial reason she dont have to leave HK after termination.
2. The health check-up is normally required by employers, so its up to you if you want her to undergo a full body medical check up, and if so you have to pay for it.
3. She can live in a boarding house while waiting for the new visa, you can also allow her to live in your house but its illegal unless she have visa from you. Normally immigration will give her a visa to stay in HK until they will give her the working visa.
4. Yes normally immigration ask her to leave within a year, that depends with the immigration when they release the visa, they will give a letter together with the visa, and there you will see what they gonna say, the reason to do this is because immigration now is not giving a full two years visa.

Can you tell me why the immigration is not giving 2 years visa? I noticed in January of this year, that our helper had only one year stamped.
BTW, this is not only FDH. We applied for a 2 year work visa and were stamped only for one year. This has so far not been a problem, and they allowed us a FDH.

I am not so sure what the reason why immigration not giving a full 2 years visa now, immigration been changing a lot of rules eversince 2003. There must be a reson behind but I dont know. But for FDH who first time come in Hong Kong they give a full 2 years visa on her sticker.
On your case i think its normal for immigration to give 1 year visa for the first time, then when you extend they will give you 2 years or 3. When I first got my dependant visa, they give me one year, then when I went for the extension they give me 3 years, and according to some friends for the next one will be 3 years again, so thats total 7 years and then I can apply for permanent ID card. Should be same with you.

It looks likely that my new DH will not get her visa until mid October. I don't like the idea of her paying for a boarding house for 6 weeks while we wait. If she comes to work for us before the visa, that's illegal yes (?) but is it often done? WHat if she moves in with us but doesn't work and she pays a minimal rent/board is that ok or is that not allowed either?
