Do I still have to pay the severance payment to my helper who id fired and making claim for severance payment if I have already started process for a new helper in place of her? We fired her due to serious misconduct.Please help!

Personally, I had bad experience with helpers before but they were terminated after a few months (not years) of work.
Ria, no offence please, but why when it's time to pay severance money a lot of employers suddenly find their helpers so bad and fire them without paying for years of hard work?
I know of one who claimed her DH crossed the road in a wrong place, another one said her DH was rude to the children (both cases based on 3-4 yo kids' talks), another one broke something "on purpose" as stated by her employer, a so on.
I'm just curious about this kind of coincidences and patterns. Sorry, it's not much related to the thread.

The subject ("New helper") is a bit misleading seeing that the issue is about the old helper. The fact that the hiring process for the new helper has already commenced is totally irrelevant. What is relevant is the rights and obligations of both the terminated helper and the employer. The following link will take you to a guide produced by the Labour Dept. Chapters 7 & 8 are relevant.
