Am having helper issues, and a colleague has said I should ask her to self terminate rather than me terminate her contract. Why would this be, and how does that effect anything? Thanks for any advice

Agreed with GreenValleys. It makes no difference really.

I might be wrong, but I thought if you had employed her for over 2 years if you fire her she is entitled to severence pay but if she resigns then you don't have to pay this. This might have been what you collegue was talking about, but, it's kind of slack to ask this for this reason I think. May want to double check this with the labour department.

Ah yes. mixeymum is correct. Still, I think that the "right thing to do" is to pay the severance.

What is the 'severance pay" and would you have to pay it if you terminated a helper before the end of the first year of the contract?

I thought severance only kicked in if you were terminating for reasons other than dissatisfaction with her job performance (eg if you were leaving the country etc). In this case, it sounds like the employer is not happy with the DH performance and in that case, termination should not involve severance?

Yes there is a reason:
If you terminate, she can walk out the door that day and you pay her a month's salary (notice period) which she does not have to work for.
If she terminates, she is giving you one month's notice and she works for that month that you pay her. When her notice period is complete you dont owe her anything - just like all jobs.
