Need advice on hiring local helper

Hello,


I am going to hire a local helper to take care of my son while I am at work. I found one who seems to be good. She was born in HK. The only thing is that she says she has been working with 3 western families without ever signing a contract. That concerns me a little bit. On the other hand, I am not sure where to obtain a contract for such purpose. She says she is freelance. I'd appreciate it if anyone can share their thought/experience.

I don't think she would need an actual contract. She is permitted to do any work since she is local. So the situation is legally similar to hiring a window cleaner.


You should ask her to sign a receipt for moneys received in any case.

If she is 'local hk' she may well have been working freelance, I don't think there is a need for them to sign a contract, as they don't have the same restrictions as FDH's. If she has been working for 3 Western familes, are they available for you to speak to, for reference?, does she have contact numbers for them.

That's my understanding too - no contract required. However, I would set out the 'terms of employment' in writing and have her sign them (and you also) to acknowledge agreement on things like hourly pay rate, hours to be worked, holiday considerations, etc etc.

Just a little post script, when paying her, aways get her to sign for any money recieved, or pay by direct debit straight into her bank, then there is never any dispute over payments. I am not sure if she is 'freelance', whether she would arrnage to pay her own tax-if any.

Local helpers are usually between $50-$80 per hour. She charges $80/hr.
