Sorry to be moaning here again...the continuing saga I have little work for my helper but she is really annoying me-have tried to be patient but think she is not very bright. i have to tell her everything several times before she gets it.My helper is a good cleaner ,honest etc but can't speak or understand much English,forgets instructions ,lists ,all the time and often can't seem to wake up/show up for work start (early for us both!) on time.yesterday she was chatting about the helper who stabbed her employer who tried to wake her up -not threateningly but as if it were just an interesting topic( Quite funny really -you would think she would draw the connection....not really..)She can't cook ,anticipate ,is dead keen to take extra outside work ... meantime I am gritting my teeth -pretty much have done for 3 months. I do everything in the house better than she does anyway...When she was 45 mins late coming upstairs this morning I said we need to talk this evening I really feel like terminating her.maybe am not cut out for this ...either of us!advice please? thanks

If you have spoken to her in the past about things which could be improved, and they haven't, then it is time to terminate her contract, it seems there is a total breakdown of employer/helper relationship, it sounds like you are getting very frustrated, and she probably is too.

so I have paid her in advance so far ; up to 22nd of Jan -have che cked out airfares for a weeks time -do I pay her the money ,give her a return ticket ,does it have to a fixed date /open and for when? what if she wants to wait and find another job?she can stay at a boarding house apparently .I suspect she wants this outcome anyway .please advise...thanks

I would advise give her a ticket with a date, it use to be they have 14 days allowance to look for a job, after that, they are supposed to be flying home and apply again in their homeland, don't know if the rule still the same, check Immigration website or call the labour dept. This is to ensure/evidence that you have done your part. Giving her cash equivalent can't prove it is for the airfares, this is to avoid future legal issue.


I have come to realised that if a helper can't learn to fit into her chores within the first three months, then she never will so terminating her may not be a bad idea.

From the day you give her a months notice, you must inform immigration within the first 7 days. You have to give her the balance of any payment due, so if eg you give her notice tomorrow, then she will have to be paid up to the 15th February. You only have to pay her a one way ticket home, from door to door-to include bus fare to airport here and any internal flights in her home country and maybe a bus to her home. Also, depending on how long it takes to travel 100hkd per day for food allowance. If you ask her to leave your residense immediately you must provide for a place in a boarding house until she leaves HK.

It would be an idea to have awitness present when you give any monies aand her air ticket and get her to sign fo everything.

I don't think you need to provide her a boarding house here. if that is the case, you provide the air ticket to leave immediately.

Jassy67 I don't think you can ask her to leave 'on the next' plane, unless she has done something terrible, like stealing or grossly disobedient, or been grossly neglectfull of her duties. The reasons for immediate dismissal can be found on the web site, HK IM, and from what I read in the original post, this DH doesn't qualify under the instant dismissal. She just seems to be a Dolly Daydream.

Under 'normal" dismissal, the employee must be given one months notice, paid up to the last day of her work, but can be given pay in leui of notice, but she can't be just 'sent out to live on the street" untill she leaves, I think the employer is responsible for her until she goes. it will also give her a chance of finding another job. If STarries emails IMM deptment, or rings them she may be able to clarify this.

OK I gave her a return ticket equivalent in cash plus she signed a waiver saying she wanted this rather than have the air ticket printed and confirmed however she has the booking details now - so its up to her to go to travel agent to confirm and pay for if she wants it or needs it.The alternative was straight onto a plane ..she didn't want that...she got her wages for a month in lieu.I could not imagine the misery and tension for both if she worked out her notice with me for a month and i think this is a known fact in HK...not on, for a number of reasons!

She has been dropped off at MTR to go back to the boarding house she was in when I hired her-silly me -will check and ask for direct refs way more carefully next time if there is one...happy to do for myself for now -less stress.Yes Dolly Daydream in slow motion may be the appropriate description..even when I dropped her off she could not get the meet up time for her other luggage pickup from me right, or shut the car door in the face of oncoming traffic...a bit not with it ,is this poor girl...like a child ...be aware if she advertises ... ,honest but dippy...sad really.

you just dropped off an employee whom you are sponsoring to be here in HK with a pocket full of cash at the MTR. Hopefully you will at least try and terminate the contract you have with her for the next 21 months ....
