Terminating contract

ORIGINAL POST

I have had many performance and behaviour issues with my helper and she is now on her final warning. She has been with my family for less than two years. What is the procedure for terminating her contract and how much notice am I required to give?

You need to give her one months written notice, a one way air ticket to her home country-- door to door, so bus fares etc to and from airport either end, 100hkd per day for food allowance, her journey may take 2 days depending on where she lives.

Her wages should be paid up to the last day of her work for you, plus any holiday allowance she may be due, entitled to 7 days paid holiday for each full year worked.

Make sure you have all payments/ tickets etc documented, and listed, keep your copy in a safe place, get a witness to sign anything handed over. Also put on the letter why you have terminated her, if it was for something quite serious, imm need to know. You may give her a written reference, but only list honest, points, eg worked from --- to ---, if she has any good points eg maybe good at ironing state it, if she wasn't that honest, don't mention honesty-- most prospective employers will 'read between the lines' and decide what they want or don't .

Inform immigration within 7 days of termination, by either, taking the papers yourself to IMm tower in Wan Chai, or faxing it to them.

If you look at the Imm website there is a sectio on terminating helpers, and links on where to send the papers.
