After 2.5 months of working in my house my philipino DH decided to quit & gave me verbal notice & she said she already informed the Img. It shocked & upset us. We talked couple of times but she didn’t change her decision. So I looked for another helper & she came for intew .after the intew my DH changed her mind & asked for second chance & said she lied she hasn’t given notice to Img.after discussing we asked her to write apology letter about what she did wont be repeated. She said yes but in the NT she disappeared from the house for 45 mins without informing me & she came back refused to give letter & I gave her verbal notice.

Coming sun she went for her hol & didn’t return.we got worried & contacted the cops as her mob was off too. They advised us to wait till mor & if she doesn’t return than file a missing person complaint. The cop said usually they do, run in between the notice period to find employment.

So basically she ran away from my house. Next mor we found out that our jewellery & money is missing, so we filed a complaint.

After 10 days we discovered that my helper already went on the same day & cancelled her missing report from the cops, so everything was planned by her.

After a month we found out she filed a case in the labor tribunal without even contacting me once, with the help of Mission for philipino immigrant workers, St. John Cathedral. For her 17 days wages & airfare, wages in lieu of notice total sum around 10,000$.we went to the labor court on hearing & by consent I paid her 2500$ which I w ould have paid her anyways if she had contacted me earlier.

So the case was settled.

Now after 2 months she filed another case against us in small claims court claiming for 21,000$ as common law damages & claiming for here 5 months salary when the case was going on which was originally filed by her with the help of Mission for philipino immigrant workers, St. John Cathedral..

I have already notified the labor tribunal & they are shocked too at her smartness.

We feel she has made a scapegoat to extend her visa & live & work illegally in hkg as she is getting help from the Philipino mission.

Pls advice as this is very stressful for me.

Sounds like you have done everything by the book and have nothing to worry about - apart from the stress level. One thing more I'd be doing, though, is changing the locks. If it were me (and I'm quite a bit more headstrong than most) I'd be meeting someone from the mission to discuss the case. They will be bound by 'client privilege' but they also need to understand the other side of the story so that they can reconsider their throwing good money after bad.

Do everything by the book and those unscrupulous helpers have no case.

tks,for the support.actually i wanted to write or meet the mission people but i have a small 1.5 yrs daughter,i am 4 months pregnant, since a month we have discovered that my hus is suffering from a very serious spine injury & so far i was just running around for him.

i feel really bad inside that i hired here in the first place.even the first time i wanted to file a case against here for mental harrassment but my family advised me against it as i have enough in my plate to run for & they said forget it shes just a helper not worth adding more stress.

if anyone has any knowledge whether this is legal or how i can fight for myself ill be really grateful.

Rachna, I am so sorry to hear about your troubles! Be brave.

I just wonder what would the skeptics from the "black list?" thread say to Rachna's story... Would they still insist that even such helper should not be black-listed?

Sorry to hear your story Rachna, but you said you had found some of your belongings are missing like jewelries and cash and made a complaint did you brought her to court? I think thats a good ground for her to be a blacklist. You can also inform thier association and can inform their consulates too.

If someone is convicted of a felony then there are grounds for that person to not be considered by others for employment.

Regarding blacklists, they are without judicial review, often slanderous, vindictive, non-substantiated, hearsay at best most often.

If you want to put someone on a blacklist, then be prepared to have yourself blacklisted. There are good and bad workers and employers everywhere, not just DH/family arrangement - lists would be too long and you could end up on so many lists

Imagine if you resigned from your firm/company and did it at a very inconvenient time personally for your superviser (but at a very important time for you personally), and your supervisor couldn't go on some little trip with his/her new partner and was very annoyed.......and for some reason you don't seem to be even getting interviews for jobs you should be able to walk into and demand what you want. Then, months later, a friend of a freind tells yo the real reason why you didn't evenmake the short list at their firm. What would you do to/about your old superviser then?

Blacklists are absurd.

hi JWM,

tks for your input.

well my intent for asking for an apology letter from her was to see whether she meant what she said that she wants to work for us inspite of her lying to me,i cant leave my small daughter who was not even a yr old in her care if i dont trust her and by asking for that clearly indicated to me that she cant be trusted inspite of us treating her like a family member..

regarding me trying to get even will only complicate & bring more work for me & its very petty thing to do for shes just a domestic helper.

i just want to solve the prob i am facing not increase it.

she did bad to me & i sure it will come back to her sooner or later.

tks
