Just heard about this new rule that seems to restrict dh from Philippines if they are under 25 years of age. Does this apply if the Philippine national is currently in HK already and is seeking to find an employer directly here? I have interviewed a Philippine national who is here on a tourist visa and may consider hiring her, but she is under 25 years old. Can anyone provide some guidance on this? Thanks.

Thanks for the info. She has worked in HK previously already for over 2 plus years, and went back to Philippines in late 2006 and has come back here on a tourist visa to try to find a new employer. Based on your explanation, starbunyip, it sounds like I may be able to hire her. She is about 9 months short of being 25.

As far as I know the new age rule CAN apply to someone who has worked in HK before. If she finishes one contract and goes home without having signed a new contract then I understand she won't be allowed to leave PH again to take up a new contract if she is <25. However, if she signed the new contract before leaving HK then she is OK. There - two different opinions. Best to check with the responsible authorities.

If what you say is correct, TC, if I sign her up while she is here in HK, whether she is on a tourist visa or just finished a contract, or terminated from a contract, BEFORE she goes back to PH, then it seems from what you said, that it is ok, is that what you mean?

A lot of variables there. I think so - definitely believe that to be the case with an out-of-contract (either terminated or simply not renewed) case, but not so sure about the tourist visa bit.

Contact the Philippine Embassy, Labour Office and ask to speak to the Welfare Officer, that will stop all the guessing.
They will always try their best to help, DH remittance is a big contribution to the coffers.
