Does anyone know if you have to pay a helper a one way ticket to the Phil (or give her the cash) if you terminate her contract because you are leaving HK and that is before the first year of contract is completed? Also, I suppose she is entitled to holidays in proportion to the number of months she has been working for you, even if you terminate before the end of the first year. I say that because I read somewhere that they are entitled to 7 days of holidays, but only after the first year has been completed. Is that correct?

As what i know, If your reason of terminating her is that your leaving hk, you have to pay her the whole contract, but if your going to terminate her because she didi something wrong, you just need to give her the ticket, and i think 1 month salary, better ask the agency.

Whatever you do, do not give her the cash in lieu of an air ticket, just look for the cheapest ticket online, buy it with her name on it, and give it to her, ask for a receipt for everything you give her.

Pay her the whole contract if we are leaving HK? I don't think that is right. Sounds very unreasonable. I'll ask Imm.

As per the money for the air ticket, I thought it was up to her to decide whether she wanted to travel so you would get her a ticket or didn't want to go home just yet so you would have to give her cash.

Anyway, I will ask Imm, even thought the other few times I have called them for any reason they are not very helpful and never give you a clear answer about anything.

This information is asked on such a regular basis that it ought to be put up as a sticky on the top of the page.

For early termination of a 2 year contrat, you give one month's *written* notice to the girl and she works another 30 days.

OR you give one month's salary and she is out on the same day.

Annual leave is calculated after finishing 3 months. Then on the fourth month she has 1.5 days earned with a total of 7 days at the end of one year.

One way ticket home to address listed on the contract plus $100 per day travel allowance. (pays for bus to airport etc)

If you are leaving HK, best to ask your helper what would work best for her re: ticket, she might find a new employer and not want to go back to her country and prefer cash

Yes, you can be nice and ask your helper if she wants to stay (by finding another employer). Your leaving hk allows the helper to find another contract without going back to her country of origin before joining the new employer.


You can pay in cash for the airfare, just ask your helper to sign/acknowledge receipt of cash in lieu of air ticket.
