DH disappears while on vacation

What can one (employer) do in cases where DH does disappear while on vacation with the employer?

What are the chances they'll be found again? Or they won't be at all?

Are we violating any laws by taking her with us in the first place?

If you had a valid visa for her to go with you then you are not violating any laws - unless perhaps she was working for you while on a tourist visa which might be a violation in some countries. If she has disappeared on her own free will then the chances are that you might not see her again - and I hate to say it, but if you read through a lot of posts in this forum you will find warnings against taking your helper with you on holiday for exactly that reason. If, however, she has disappeared at the hands of others then sad to say the chances of you seeing her again are also quite remote. Depending on which one (did all of her 'valuables' disappear with her - that could be a sign) you could simply terminate here. [I'm assuming here that you have already gone and she has already disappeared.]

Thanks TC.

Should we report her to the local authorities over here?

Should we notify the Immigration now or later when we're back one week later?

She didn't seem to be the person who'd do something like this. She's been with us for years. This is not the first time she comes with us so we never really see this one coming :(

Oh dear....

Where is 'here'?

And where is home (HK?)?

If she is genuinely missing I'd at least report it as a 'missing person' incident to the local police. Don't necessarily expect anything to happen, but at least you've done the right thing.

And if home is HK I'd inform them on return as it's only then that you are sure she isn't with you when you get back.

Can you give us some more details. This sounds really confusing.

Sorry... just can't think right atm.

We took our helper with us for summer holiday in Europe as we have 3 small children. This is the 3rd year we took her along. Only that this time we gave her a mini vacation to see her sister (who's also working in Europe).

She's supposed to return from her trip 3 days ago, and still no-show until today, nor a single telephone call. The numbers she gave us are all unreachable (voicemail).

This is unlike her at all...

So we've come to a conclusion that she's disappeared on us for a better pay and life in Europe.

She's on tourist visa here.

We're due back in 1 week time.

Definitely we need to inform the local authorities here. But am not sure if it's legal in the first place to bring her here on tourist visa while she performs her duty as a DH.

And what should we do later when we're back in HK? Just send a letter of termination the ID, or we also need to inform them that his person has disappeared while away with us?

Okay that makes things clearer. I don't think you have to have special visas for helpers travelling with you on holiday. Best thing to do would be CYB (cover your butt) and report it to the local police. Then you could get some sort of letter from them to present to immigration here. That should leave you in the clear. It's a pain in the behind, I know, but also, in case something untoward has happened to her, authorities have been notified.

"not sure if it's legal..." - but you're happy to break any relevant laws without making the effort to find out. My sympathies for the inconvenience you are now suffering at having to care for your own children, and I know this sounds all so very sanctimonious...but why am I not surprised. There, got that off my chest.

As inkonkoni says, report it to the local police and retain a copy of the police report. Then when you return to HK (assuming she isn't back with you by that stage) officially terminate her in absentia and inform Immigration accordingly. And if she IS back with you by the time you arrive back in HK also terminate her. Good luck.

Something may have happened to her??

Or am I being optimisic???

You will need to report her as a missing person in the country you last saw her in and possibly the last country you know she was in - you can always say she is a friend of the family who joined you on holiday - not exactly a lie.
