Compulsive Dismissal

Can anyone advise me if its possible under the laws governing Hong Kong to bring a case on Compulsive dismissal against my employers.

I have been forced to resign due to the company not acting on my compliants about bullying. I have been informed that if my contract was bound by UK law I would have a very strong case.

You mean constructive dismissal?


There is no unfair dismissal law in Hong Kong. If your employer wants to fire you, they can. They need to pay you severance of 2/3 of a month's salary for every year of service (up to $15k/year max) if you've been there longer than 2 years. This severance can come out of the employer contributions to the MPF.
