I signed a two year fixed term lease with my tenant with no break clause. The two years expire in 2015. However she decided she wanted to leave and so stopped paying rent since March.
She moved out this week only after I got a court order and then posted a notice stating that she had 7 days to clear out failing which I would repossess my flat and her stuff would be chucked out.
As predicted, she turned up on the seventh day. I checked in on the flat as she was moving out. The flat was in a complete mess with plenty of empty shoe cartons. I had warned her previously to get rid of those as these were residential premises. I had even taken a photo during our meeting in March by way of evidence to show that the only room in the flat being stacked with Shoe cartons from floor to ceiling. She had been running a business from my flat, probably more as a warehouse. Obviously, my warning went unneeded.
Anyway, when she was moving out, I decided not to be in her way, so I went down to wait near the lorry where she and her mate were loading their stuff. I was waiting for her to return the key after loading up. Instead, she just got in the lorry after loading up and away it went.
I am now having to pay for breaking the lock and chucking out her unwanted furniture, cleaning and painting the entire flat as her kid has drawn on all the walls and hung drawings everywhere too. Her phone number no longer works. She is originally from China. Her husband resides and works in china.
She has already used up the two month security deposit in the time it took me to get the court order. There were letters in the trash outside from numerous entities like phone, light, gas, water and other people chasing her for unpaid debts failing which they would take legal action. Even letters from where she had previously rented from people chasing for money owed by her.
It would seem to me that this is how she usually operates. Whenever she is ready to flee, she does not pay the final rental or bill etc. I would really like to know how I can get her to pay the judgment debt she owes me and ongoing damages.
More importantly, how does one stop someone like her from continuing to take advantage of the tenant-favorable laws in HK and ripping everyone off each and every time she changes residence?
I know she has rented another property in Hk but don't know where. Yet another landlord who will get ripped off and the story repeats itself.
Naturally, I am upset as I have had to and will still have to spend time and money on taking care of the mess I am in. I would really love to take steps to stop her once and for all from cheating the rest of the world. Any suggestions on how I may recover from her financially speaking? And how I could put an end to her modus operandi?
I feel really let down. Such a pity that the tenancy laws in HK have no teeth. Seems to me that the local or Mainlanders really know how to beat the system.
