HK ID for adopted child?

Hello,

I grew up in HK, have HK permanent ID and am living in US. Husband is US citizen. We'll be adopting a child from China (through US agency). The child will become a US citizen. Will this child be allowed to get a HK ID? (I think birth child of mine will be allowed, not sure about adopted ones). If so, do I have to apply for him by a certain age?

If your child is Chinese and born in China - do you have birth certificate? and if you are Chinese then you may be able to apply for verification of permanent resident for her in hong Kong. Best place to check is HK immigration department. They respond to emails quickly. Your child I think is automatically recognized as a Chinese national based on place of birth and of Chinese race. She won't get an ID card until she is 11.

This may be a more complicated matter than you realize. Firstly, there is the question of the current rights and obligations/status associated with your own HK ID card. If you have been away from HK for more than 36 months, you may have lost your “Right of Abode” which qualifies an individual for permanent residency status. Also, your son does not necessarily have a Right of Abode based on your status. For a non-Chinese person under 21 years of age to have the right of abode he must be born in Hong Kong to a parent who is a permanent resident. For further advice on this matter you should contact the Hong Kong Immigration Department and/or a reputable immigration lawyer.
