i missed my income tax first instalment due date

I paid some part of my income tax (first instalment) before the due date but for got to pay the remainder amount as i mis-read the last date to be 30 Jan (instead of 03 Jan, which means about 15 days delay). As soon as i realised my mistake, i have now paid the remainder balance in full and also the second instalment (which was otherwise due in April 2012).

I am worried if the authorities will prosecute me.

No. You will just get a late payment charge which is a percentage (10%?) of the unpaid amount.

the percentage should be on the demand note I believe it is 5% on the whole amount for any late partial payment

Yep, no need to worry. Just pay the penalty when the IRD demands payment. If there's no demand, the better!

I also missed my first payment by one week last year. So, I paid first at the post office, then immediately faxed a photocopy with an apology and the reason (I simply stated that due to my busy schedule I forgot and I sincerely regret it). I was not asked to pay any penalty last year. Maybe because it was the first time, I don't know.

The authorities are unlikely to prosecute you.


They may levy a small penalty and/or interest charge. Suggest you immediately write a letter to IRD outlining any mitigating circumstances and request waiver on this occasion.
