Hello,

I had to pay for my whole income ( housing allwoance+ base salary) tax, although it is written in the work contract that I have a housing allowance.

The revenue dpt. says the my company had to make an exercise controll, where they controll if i payed monthly my rent. They didn't do that. But the revenue dpt. has all my copies of my monthly rent and hotels.

Please give me a legal advice!!!! Or does someone knows a Lawyer who can help me??

Bye Bye...

The Hong Kong tax laws grant a housing allowance where either the employee or the employer pays rental for a hotel, flat or house in Hong Kong.

So long as the employer records the payment in his annual return of employee remuneration the tax department will grant the allowance to the employee. It should be a straightforward claim.

Does one's name have to be on the tenancy agreement to claim housing reimbursement?
