I have been seperated from my wife in the UK for over two years, at first on an uncontested and amicable basis she was divorcing me on the grounds of adultery. This was supposed to work out as six months and lower cost as she was divorcing me and recieving legal aid to do so. Over two years later I am still waiting and things have deteriorated to the point where I may have to divorce her and she will not give the divorce. My UK based lawyer tells me if that is the case I would/could have to wait 5 years if she will not co-operate. I have been told that I can divorce her from here in HK where I now live and work and that the law here is two years seperation. has anyone experienced this process and how difficult is it? I am a UK citizen

freddy, if your have substantial connection in HK, you may take out divorce proceedings in HK.

According to Section 3 Chapter 179 Matrimonial Causes Ordinance:


JURISDICTION OF COURT


The court shall have jurisdiction in proceedings for divorce under this Ordinance if-

(a) either of the parties to the marriage was domiciled in Hong Kong at the date of the petition or application;

(b) either of the parties to the marriage was habitually resident in Hong Kong throughout the period of 3 years immediately preceding the date of the petition or application; or

(c) either of the parties to the marriage had a substantial connection with Hong Kong at the date of the petition or application.
