No Money Back

My Husband and I had 4 pairs of boots made from a shop in Causeway Bay who clamed to be Master shoe makers. We liked the styles in the shop and had them copied. We have had numerous problems with the shop and the boots. The first time 2 pairs were made a size smaller. We ordered new ones and only one pair was ordered. The high heels of both my boots worn off after wearing them for only 3 hours. We paid 890 for the mens and 1000 for the ladies each. Now my husbands other boots have actually come apart, the heels and the fake leather has peels on the top of the shoe. After wearing them for only 2 days. We returned them to the shop and they said they will not give us back the money and they will not replace the shoes. We are just amazed and disappointed with the service and we want our money back. We really feel ripped off and want our money back. The store promised real leather shoes. Do we have a case? We just don't want to let this go.

This is far more common in HK than I am used to in Europe. In fact, I expect this kind of service from just about everybody most of the time now. I am tired of getting HK people to take up grievances of this sort; most of them just think it's just the way things are or couldn't be bothered. People keep telling me how energetic the place is; I see lethargy and tensions everywhere. There is this BMW internet forum where a lot of enthusiasts and owners post stuff. A mechanic was the "official" recommended one by the forum administrator. One time a young chap, new to HK and the forum, made a very strong complaint about the said mechanic's fees and services. Within hours the forum was swamped with horror stories about this chap's shoddy work and services. For years, not a single person said a thing in public. Not only was the mechanic unrepentant, the chap who endorsed and recommended him to all his members jumped into the fray and accused individuals for stirring up trouble. (Sounds famimilar - newspaper stories daily about this sort of things, from small businesses to large corporations)

I don't know what the Consummer Association does here. May be they might take it up. Is there an equivalent body to The Trading Standard Office, in UK? They normally take things up quickly. Caveat emptor is taken to an extreme in HK and the people accept this. Whenever someone demands the government or the large businesses to alter their approaches to these issues, I constantly overhear comments like why can't people mind their own business and why do they want to stir up trouble. I hear them on the trains and the tea houses regularly.

Hi there- I haven't written to this organization so can't vouch for its effectiveness or response, but try the Consumer Council...

Thanks so much for the advice. I paid by credit card. But I didn't think I could do cash back for the shoes because I haven't returned them to the store. I have called consumer council and ythey have not responded to me yet. The credit card compant said that if I make a case for the money back and they find the shoes shop is not at fault then I will be charged. The problem is only 2 pairs are really bad and the bill has 4 pairs charged so I'm not sure it's fair 2 have them take the whole bill away. I wouldn't mind giving the story to the tabliods. They were so rude and truly morally wrong and I'm not going to let it go. This is not the first time I have been cheated in HK, I've been here for a 3rd of my life. You never get used to being cheated it still upsets me. Thanks much for the advice. I will call consumer council again if I don't hear back by tomorrow I'll call the bank credit depatment. Thanks!

It all really depends on how the store "promised real leather shoes." Was there a sample shown to you? Was there a description in a catalogue of some sort? The facts will be critical. I would suggest arming yourself with all the documentation available (invoice, catalogue, advertisement if any) and coming into our office for a detailed discussion. Our charge for a conference of 1 hour is HK$2,500.

Thanks again. The store does have samples in the store that you look at then they have a leather catalogue where you pick out the type of leather and colour. These catalogues are only at the store to look at. I just found out my husband can't find the receit. We have the shoes and we have 2 witnesses we bought the shoes there. The shoes themselves are just a mess. As soon as you see them you can see they are plastic and the material is actually peeling off the toe and the heel is coming off. They were worn only 2 days.We bought them by credit card and we found the transaction. Like I said the store has made so many mistakes with all the shoes. The first pair made 2 sizes to samll. Had to wait for another pair and the heel of that boot actually worn off after 3 hours. I agrued with them and they replaced the heel the next day. My husbands first 2 pair of boots were both ordered in the wrong size and felt disappointed with both pairs. Do we have a case now that we lost the receit? I have the shoes and they can't claim we didn't buy them there. Thanks

I'm not going to sue. I can't afford to pay a lawyer but I will ask for a charge back from visa. They may deside not to take our case since I found out my husband lost the receit. I still have not heard back from consumer council, maybe I should right a letter instead of calling.

Thanks I didn't know that. I just took pictures of the shoes. Does anyone know a good reputable shoe maker that would be willing to give me a letter, I honestly don't know a place, I'm sure there is lots?

Call Visa and tell them you dispute the charge. The phone number is in the fine print on your bill. Just dispute the whole thing. From there, Visa will investigate and sort it out. Be prepared that the merchant will tell Visa that you are a liar and claim they never showed you a leather sample, etc. Like any reasonable person, the Visa investigator can smell when a rose is not a rose. Just stick to your guns and tell the truth, preferably with photos and witnesses to back you up.

Wow "Associates" - suggesting legal action over a couple of thousand dollars purchase? Also I would bet that if the goods are "not fit for purpose" e.g. boots that wear out in two days, then a consumer has more avenues for recourse than you suggest (well this is certainly the case in every other legal jurisdiction based on British Law that I am aware of). You have some hide (excuse the pun) suggesting someone spend $2500 an hour over a pair of fake leather shoes!
