I was wondering if anyone knows if there is a particular body in Hong Kong to get advice re your rights as a tenant? I am trying to find out what constitutes fair wear and tear as we have just moved but the owner won't release the security bond. A small amount of peeling wallpaper which was peeling when we moved in and damage to kitchen cupboards which is completely untrue.

This is a common occurrance in HK. It is advisable to take a dated picture of all damage prior to moving in and then take a selection of pictures when you move out. I think once you fire off a lawyers letter to your landlord he will release the security bond pretty quick. Good luck!

thanks. The owner actually attached a few photos to the lease which has a couple of kitchen cupboards so going there today to take our own photos. They want to charge $1500 to repair the tiny bit of wallpaper that is peeling from the humidity. We should have just glued it up before we left....lesson learned! Do you know how long they can hold the bond?

The length of time the bond can be held should be stipulated in your contract, normally within one month of moving out but generally 14 days. How long have you been living there? as if over a year you could certainly argue that a small bit of wallpaper peeling off is wear & tear. You will find many of these landlords try it on. If I were you I would threaten landlord with legal action, which should do the trick and if not send him a lawyers letter as that should do it, as they generally don't want the hassel. You will be on a much better foot with photos in hand.

We lived there for 14 months. It is actually through Hang Seng R/E. They initially had a list of numerous trivial things which they withdrew but now have about 3 things they won't back down on. Have just demanded everything be put in writing as we have done that but they have not. The oven door of an extremely old oven starting sticking after we moved in but still works and they are getting quotes for new ovens!!!

It is for these very reasons that tenants do not to pay the last two months rent. Next time use the deposit up in rent.
