We are currently renting a flat which comes with a car park space (which we do not use because we do not have a car). Are we allowed to sublease the car park space to someone else in the building? If not, what is the penalty? Thanks for your advice!

can't see any reason why not, unless your tenancy agreement specifically precludes sub-letting?

Also, you would have to structure your sub-lease such that its terms are dependent on your situation. For example, if your landlord can terminate your lease with 2 mths notice then you need to be able to terminate the sub lease with less than 2 mths notice.
If you are not allowed to sub-let the space (under the conditions of your lease) then I would suggest the "penalty" is that you are legally bound to pay for a car space that you don't use.
