I found jewelry missing from my home and reported to the police after firing my helper who we suspected and now police has found some records of some jewelry with her ID num,if she is arrested what will the legal procedure be? how much time will she have to spend in jail if they have proper evidence,do we have to prove something...I know i sound silly ....but never had an experience in all this so please advice.

Even with the proper evidence she still has to be found guilty in a court of law. You will need to appear as well. And absolutely you will need to prove. Something to do with being innocent until proven guilty. As for the likely jail term (or not - maybe it could be something else) then that depends on the relevant law and how the judge feels on the day (if he/she has any leeway).

Theft is a criminal offence and the HK government will prosecute her if they has a prima facie case, that is the evidence on the face of it established the offence. She will then be brought to court and may or may not face imprisonment. Your involvement will include identifying whether the jewelery actually belongs to you and how they are lost, perhaps some background of her employment with you.


I can surely understand freedom of speech but comments that are half true or misinterpreted will not help PPL here.

If that was a jibe aimed in my direction then all I would add is that NOBODY should take legal advice given in a public forum such as this as gospel. Much better to take the advice on face value as maybe a starting point but then get the facts from a 'proper' source. Good luck anyway, Ria.
