Can anyone advise on whether you are still entitled to your Chinese New year bonus if you are still with the company but happen to be on maternity leave at the time the bonus is paid? The employment contract simply states that the employee must remain with the company at the time of payment of the Chinese New Year bonus. Maternity leave was taken one week prior to CNY holidays and the bonus payment. Any advice would be very welcomed. I have looked in the ordinance but it does not seem to cover this.

As far as I know the CNY bonus is not a statutory requirement, it's only paid if it's stated in the employment contract. But from what you've said you should be entitled to it, if it's yourself you're talking about. I would suggest giving the Labour Department a call and asking them.

I don't know if they have too legally but I would've thought you would be definitely entitled to it. I got mine when I was on maternity. I took extra no-pay leave so left in October, got my bonus in February and went back in March.
