Difficult Landlord

A friend is trying to get his deposit back from his landlord. The flat was actually in pretty fair condition as far as I could see when he left, but the landlord is trying to make him pay for every little defect he has found.


The lease has a "fair wear and tear" clause in it.


An example, he wants to charge him to repaint certain walls because there was the odd mark and paint chip.


Photos have been taken and shown to someone who works in leasing and they agree it looks like fair wear and tear.


Long story short the way this is heading it's going to end up in small claims court.


Can someone please point me in the right direction to start getting hold of relevant forms etc to file a claim.

First your friend should address a letter to the landlord by registered post stating the grounds on which he should refund the deposit, and further stating that unless he does so within 7 days, a claim will be made at the Small Claims Tribunal. It is at Wanchai Tower, Wanchai, from which you may collect the forms.
