Legal Question about Work VIsa

My husband's company has transferred us here for a few years I have an HK ID as his dependent. I would like to set up an E-bay store selling goods mainly to the US and Canada. Do I need to apply for a work Visa and Business Certificate or can I have my business based out of the US even if I am using the Hong Kong mail system to send the good directly to the buyer and buying the goods I am selling here in Hong Kong? I am not looking to sell anything expensive and I don't want to use a lot of Capitol to start the business. Any help would be greatly appreciated.

As a holder of a Dependant Visa you now (since May 2006) have the right to work in HK in your own right. If your DV was issued before the change (it doesn't sound like it) then there would be an employment restristion stamped in your passport, but it is a very simple process to front up to Immigration and get it removed. If the DV was issued after the change then there's no such restriction on you working in HK.

There are thousands of eBay traders in HKG and I would doubt that any of them have registered as a business. All you're doing is selling a few items same as advertising on the trading section of asiaxpat.


If you are using an existing USA registered eBay and Paypal account you can carry on using it from here no problem.


It may be worthwhile having a US and a HK registered eBay / Paypal account and then you can withdraw money from Paypal to whichever bank account you prefer either here or the US.

If you do business in HK, you should have a sole propriotership business license AS A Minimum.....you are a dependent so a visa is not a problem.



A sole proprietorship business visa will cost you UNDER HK$400.00 form the inland Revenue department.
