I have been told by my employer that they have advertised my position. (three weeks ago) and it was all very vague, but they'd like me to stay while the search process goes on - because whoever they hire to replace me will probably have to give three months notice.
My employment letter is one months notice either way.
Since this news, I have met with headhunters and have a couple of possible interviews - yet to be confirmed. I have told them I need to give one months notice.
YEsterday (Wednesday) my boss asked me to work out two months - to the end of July and the HR is giving me a letter to confirm this.
I want the flexibility to be able to leave with four weeks notice should one of my interviews result in a job offer.
There is nothing worse than staying in a job where you're clearly not valued - worse than a relationship!
So, my question is, can I write a clause on the page saying - I agree to work through to July 12 - however, should my circumstances change, I am entitled to revert to one months notice - per my employment agreement.
Is there are clear legal way to say that?
Many thanks for any and all suggestions.
Eileen

I don't think the letter they are asking you to sign has any basis in law. I wouldn't be signing it. If they don't like it they can give you one month's notice - or pay you that one month's salary and ask you to leave now. You can always give the honest reason why youi don't want to sign it - because you are clearly not wanted and are therefore looking elsewhere, and if you get something you want to be able to honour your obligations and give one month's notice.

thank you - are you a lawyer.?..I think their argument will be that it is better for me to resign rather than get the dreaded 'termination' letter...however, i just don't have the date i want to resign yet cause i don't have another job to go to.
clearly they have identified someone and they know they want me out of there mid july
