if paid maternity leave is 10 weeks in HK, what about unpaid maternity leave? is there any type of unpaid maternity leave that mother's can take without having to dip into their annual leave?

Basically there's no official unpaid maternity leave. It all depends on how you negotiate with your company. I took extra 3 months off (unpaid) after my 10 weeks. Nothing to do with the annual leave as that's 'paid' leave.

Nicher is correct. Any "unpaid maternity" leave would have to be negotiated with your boss, who does not have to agree to it.

I asked for 3 months unpaid leave, and eventually they agreed to 6 weeks.
But they are under no legal obligation to do so.
I also asked if I could use my annual leave, and they would not let me - while other companies do allow that...
So after the 10 weeks, it is all very individual and they have the legal right to say no.
Also, read the law carefully... your company can technically start the 10 weeks two weeks BEFORE the birth, so you really only get 8 weeks. I made sure that my 10 weeks started the day of the birth.

That's me. My '10 weeks' started 2 weeks before due. So I had only 8 weeks paid maternity leave after delivery.

right. my company tells me "you have to use up your annual leave first before you can apply for any unpaid leave". but i want any unpaid leave to be seen as "unpaid maternity leave" with the reason being that i just had a child. thereby minimising the risk of having to take unpaid leave later on down the road for no apparent reason except that i've run out of annual leave!!! it's just always nice to have annual leave up your sleeve. don't really want to use it for maternity if i can just get unpaid leave now....
