When should my annual leave accrual start? From my first day of employment or after any probation period? Is there an official guideline or ruling on this from a workers association? hope you can help! cheers.

should be from day one with usually a caveat that you cannot take leave until after the probabtion period has finshed.

Employees are entitled to annual leave with pay after completion of 12 months continuous service.
But many companies allow staff to take annual leave before this. Check with your HR department.
Also, by law, the employer can dictate when you take your leave. But, again, most companies don't do that - I do know of some which close down for two weeks at CNY and all employees must take their leave then.
Holiday pay is only paid after 3 months' employment.

thanks for your responses although they're kind of conflicting. I get 3 weeks a year and if I started on 20Jan07 with 3 months probation should my 3 weeks leave be counted from 20Jan or 20Apr?

thanks Greenvalleys. I found the HK Labour Department on line. if anyone else needs the link in the future it is here: http://www.labour.gov.hk/eng/news/content.htm
I just work for a small company so there is no HR Department. I'm pretty sure my annual leave days should start from my first day of employment even though I cannot take leave for the first 3 months during the probation. cheers.
