Lease re-negotiaion

I was in Europe when my lease expired my landlord was happy to wait until I return to HK to re-negotiate the new lease, they made an offer wanting a 34% increase pls govt rent and rates.

I submitted a counter offer and have received notice to quit the builidn in 11 days time.

Is this legal as my lease says 2 months notice in writing by either party.

What should I do to protect myself and my property from the landlord

If your lease says the lease can be terminated by either party with 2 months' notice then the landlord cant end the lease with 11 days' notice. Did the landlord serve you notice when you were in Europe? Negotiation or re-negotiation does not stop the clock on the 2 months' notice if they did serve you notice before you were started negotiating a new lease.

I received nothing from them prior to this notice.

Does the time start from the letter dated 2nd october or do I need a new letter, can I take them to rent arbitration?

If you lease says the landlord has to give you written notice and you did not receive anything until 2 October, then the two months start from 2 Oct. You are entitled to stay til the end of the two months. Normally, it is written notice. I would suggest writing to them to challenge them on this point.

The OP stated that her lease had expired therefore it does not matter what the lease says, it's already a terminated contract. The landlord does have the right to ask his tenant to leave once the contract has expired.

evildeeds is right if your lease is a new lease (after the change in legislation) then once a lease has expired you have to vacate the property. If your lease is an old lease then you have become a month to month tenant after the expiry of the lease.
