Hi, My wife has been in HK since Jan 2000 under a dependency visa sponsored by her mother but left HKfor one day short of a year in 2003. Her visa is uninterrupted and she has worked the whole time she has been in HK. We married in Dec 2006. I'm a UK citizen here on a tourist visa. My wife would like to apply for PR and a dependency Visa so I can work in HK. How hard would this be? Would it be better for her to change her visa to a work visa then I get a dependency visa on that?

Once you have 7 years of residence in HK, it is relatively easy to get your PR. It's easier and more convenient for her to apply for her PR rather than change her visa to work one and then get a dependant visa for you. You just need to be able to satisfy the Imm Dept that you have been residing here CONTINUOUSLY for 7 years. You will need bank statements, copies of tenancy agreements, employment contracts, etc, but it is a very quick process.

The only fly in the ointment that I can see with this is that to be continually resident means you have not been out of HK for a continuous period of more than 6 months. You mention she was gone for nearly a year. Usually this starts the clock ticking again so you need to be careful and have reasons ready for immigration if they ask about this. There is always a question on the forms which ask if you have been out for more than 180 days and is checked.

Sorry, I had misread your letter. The clock definitely started ticking again in 2003 when your wife left I'm afraid. Your only option is get a dependant visa through your wife, if she can get an employment visa.
