Hi,
Do you need to be separated first before getting a divorce in HK?
If so, how long do you need to be seperated before filing for divorce?

Just one more question. How do you and where do you get Legal Aid from? I have seen a solicitor but they are to expensive and we do not have that much $$.

Actually, you can apply for Legal Aid before proceedings are commenced. You just tell them that you wish to apply for a divorce and see if you are eligible. Yes, you do have pass their means test. And you definitely have to be separated before you can apply for a divorce - unless you're a Muslim, of course.

As far as I'm aware you have to be separated for two years and then both parties have to consent. If one party objects the other has to wait for longer unless they can prove unreasonable behaviour. To qualify for Legal Aid you have to have a ridiculously small amount of money.
