You cannot simply change an FDH contract to another person. The correct procedure is the FDH either resigns or is terminated from the employment of one person and the next employer then submits the paperwork for the new contract.

Bear in mind that the current employer is liable to provide a ticket home for the FDH or the cash equivalent. And, if the helper is from the Philippines, you will also need to now do all the paperwork through an agency or put up a HK$50,000 repatriation bond if the paperwork is done by the new employer.

OK, well the $50,000 repatriation bond is if you hire her as an FDH and do paperwork yourself. For what you want to do the process is different and one might say impossible depending on the job you are employing her for - here's how it would work.

She would need to be terminated from her current FDH contract and would need to return to the Philippines. That is part of the contract and must be done. You would then need to apply to immigration for a working visa for her proving that the job she will be doing cannot be done by a local person. If they agree then they will issue a working visa and she can come back into HK. But, and it is a big but, this depends on immigration. They are really going to want to know her skill set, will question why she was a DH previously, etc. So you will need to make sure you are 100% positive you will succeed before you go down this route or else you may find she wont be able to come back.
