update: Wife has now gone to Immigration and been (perhaps rightly so) grilled over why our son has overstayed his visa (he's 3). We are now trying to get his stay extended, and need to return tomorrow to try to convince them... Does anyone have any experience with talking to the immigration people who could recommend some tips on how to get them to give the extension? At a loss about what to do as he is over his stay and we desperately need an extension so he can leave the country for an upcoming trip. Right of Abode application is in the works but will take who knows how long! Again, we both have Permanent residency and know he is ultimately entitled, but we need the extension of stay so that he can travel in the meantime...

My wife and I are now both permanent residents in HK. Our son was born in HK before we became permanent residents. There is no established note on his birth certificate or in his passport that he has right of abode. We will be travelling soon outside HK and his dependant visa is long expired. Does he need some type of indication from the Immigration Dept. that he has right of abode established? or ? any advice appreciated...

What type of passport does your son have? Leaving the country should not be a problem. It's re-entry depends on passport type.
we were in a typical situation when leaving on holiday and we reapplied when we got back - no problem.

It's a Canadian passport. We were told we may be "delayed" at the airport leaving... can they stop him from leaving?

There is an immigration department at the airport. They can sort out but you would need to pay and go early so you dont miss your flight!! I don't see it being a problem as he's only 3 years and dependant visa but best to sort out in Wanchai Immigration if possible.

The same thing has just happened to me. I had overstayed by 3 days just before CNY and I thought I would be ok going through immigration at the airport but I wasn't. I was taken to the immigration area which is next to where they X-ray the baggage and had to fill in an extension of stay form and pay $160.00. On coming back to Hong Kong, I have re-entered as a tourist until my new visa is sorted out which will be another couple of weeks. Hope this has helped. The other thought is for your son to depart as a tourist.

For peace of mind, I would go to Immigration Dept in Wanchai to sort out the visa with your air tickets if you have time.
The airport immigration will give your child an extension visa for a short period till you return. Then re-enter as a tourist and then arrange for new visa. you end up paying twice. This is what happened to our child.

Thanks Crystal. Am going today to Immigration and will be sure to take the tickets - good advice. We don't mind paying; just can't wait 6 weeks for ROA to come through...
