Oasis Bankruptcy - Refund for Cardholders

ORIGINAL POST
Posted by sidsingh 18 yrs ago
All people who have purchased tickets for Oasis through their Visa/Mastercard credit cards can claim refunds through their card issuing banks.

Under consumer protection rules set by Visa & MasterCard, the cardholder has every right to demand the payment from their card issuer if the merchant ( OASIS) does not render service for which they have collected advance payments. This is called a chargeback in the credit card industry and all Visa/MAstercard cardholders can chargeback citing " Service Not Rendered" reason code. Am not sure about Amex.

Called the HSBC Credit card Hotline here in HK. Aparently there is no consumer protection insurance on their visa cards here in Hong Kong. Not sure if this applies to all other Hong Kong banks. If anyone has any further info on this I would be happy to hear about it.

Has Oasis airline gone bankrupt? does that mean they'll not operate from HK anymore? when did this happen if so?

Happened Last week, and they have gone bankrupt and to my knowledge, no flights are running and ticket holders have been right royally screwed over.

Badger 744,

There is no "insurance" coverage BUT you have right to ChargeBack the transaction on the grounds that the service has not been rendered. So if you purchased tickets using your visa ( or mastercard) irrespective of bank, then please call the helpline and tell them " I want to chargeback an oasis airlines transaction as the service has not been rendered due to the company getting liquidated". the issuing bank cannot refuse you. they will give you a temporary credit and then place a debit with Visa. Visa in turn will debit the merchant ( in this case as the merchant is no longer in operation, the merchant's card processing bank will bear the cost)

hope this helps

sidsingh,

Just wanted to say many thanks for the info you provided. I called up the HSBC hotline again and quoted your statement for chargeback, along with reminding them about recent press coverage. They said I needed to fax all the details and copies of tickets to them and I should hear within about 6 days. Well good news is yesterday the full amount was credited back to my credit card.

So again many thanks for this as I would still be waiting with fingers crossed for some refund from the Oasis liquidators!

Yes thank you Sidsingh. We took your advice when you first posted and was credited with the amount. We informed a friend who was also having trouble and he now his money back. Two happy people. Thank you.

badger and sargirl,

When were you supposed to travel? Is your card Visa?

My Canadian TD Visa won't provide a refund until after the return date of my plane tickets (August), so I'm left with 15,000HKD outstanding on my card until then. Wondering if HSBC is providing refunds immediately regardless of travel dates? Thanks!

Travel dates were London-Hong Kong 14th April and return 2nd May. The refund was credited to my HSBC visa card 22nd April. I have also recieved a letter from HSBC to sign confirming the details were correct and to be returned within 10 days.

TMK,

Oasis has filed for liquidation, there is no way your return ticket will materialise. Are you past your first journey date ? If yes, then you can argue that "service has not been rendered". If not, then be patient - your issuer will eventually refund. Just make sure you file a claim after the return date.
