What are the rights of a Foreigner

Hello:


I would like to know what does the law say about foreigners when they have a child and divorced to a chinese woman. I do not want to repeat the situation that i explained earlier but i am just interested in the law.


What i mean by this is. Does a foreigner have the right to a residents permit? Does he need to get a special visa? Where can somebody get the right information and do not deal with lawyers that the only thing they want is money.

That is actually incorrect. If you marry a HKPR regardless of whether they hold HK passport or not you actually become a dependant and after 7 years get permanent residency. If you divorce in that time you lose your dependant status regardless of whether you have kids or not.


Not sure of the situation in China, but I would assume it's even tougher than HK.

Marriage to a PRC national does not qualify one for a residence permit. Why would one expect one when one is divorced from a PRC national?

PRC does not give residence permits based on marital status unless you have been 5 years married and living in the country. Full stop.

Being in China for some 7 years. Not a chance pal, unless you actually make a mayor investment in China.

^ Major as in over $2 million. And even then you need to sustain that investment and live here at least 2 or 3 years before applying./
