Can I Work as Self Employed in Beijing?

Hi, I have recently entered Beijing as an employee of a Chinese company and everything is above board, i.e. entered on work permit, Z Visa and registration has been complete.

However, if I reach an amicable agreement with them to terminate my employment, including re-paying their expenses, could I start to work on my own, call it either "self employed", "consultant", "freelance" etc etc? The job is outdoors, in public, coaching, so there is no way of keeping it private.

I would want to be above board with no worries and would expect to pay tax etc on income.

Many thanks for any advice or pointers.

If your employment is terminated, your work permit will be cancelled and you cannot legally work any more. The Public Security Bureau may, at their discretion, also cancel your residence permit. But even if they don't, you cannot work.

It is not possible to get a work permit / residence permit if you are self-employed unless you have formed a legitimate legal enterprise.

gdbill, thanks again for this reply.

I didn't mention before that my wife is Chinese (Beijing). At the moment she works in UK on a dependent visa based on being married to me, does anyone know if there is a system in place in China whereby we could reverse these roles with ME being the dependent and able to work legally in BJing?

Thanks, PM.

There is a one-year multiple entry L visa available to spouses of Chinese nationals. It does not, however, entitle you to legally work. You need to apply for the visa in the city in which your spouse maintans her hukou or, if employed outside of that city, where she maintains her approved temporary residence.
